Compensation Claims

Several conditions caused by occupational exposure to asbestos are well recognised and those affected who have been employed in a prescribed occupation can claim compensation. Stringent criteria must be fulfilled in order to establish the link between occupational exposure and the condition. Some asbestos related conditions are:

  • Pleural thickening – thickening of the lung walls
  • Pleural plaques – areas of scar tissue on the lung
  • Asbestosis – scarring of the lung tissues leading to reduced lung function
  • Mesothelioma – tumour of the covering of the lung or the lining of the chest wall.

Often a conclusive diagnosis can be made on the basis of an occupational history and laboratory tests and such people would be entitled to government compensation. In addition a civil claim can be made against the responsible company. More detailed information may be required for such claims and may not be possible during the person’s life. The procurator fiscal is involved after the person’s death and may instruct a Post Mortem examination both to clarify the individual situation and to consider the implications for wider society.
