Legal aid is also generous in matters related to incapacity. Legal aid is available without any means test whatsoever in most cases where a guardianship order is required with welfare powers and where the adult has recently or suddenly become incapacitated. Court proceedings of any type are always expensive and being aware of this fact can save any family involved in obtaining Guardianship orders many thousands of pounds. Many Scottish solicitors may not act under legal aid – choose one which will on this matter.
